Operating a bar in India requires a comprehensive set of licenses, primarily governed by individual state excise departments because alcohol regulation falls under the State List of the Seventh Schedule of the Indian Constitution. The process is highly regulated and involves strict compliance with local, state, and national laws.
Key License Types :
• Bar/Restaurant License: Required for on-premise consumption of alcohol.
• Foreign Liquor License (FL-1/FL-3): Generally for high-end hotels and restaurants serving all types of imported and domestic spirits.
• Beer and Wine License (BW): Often for cafés or casual dining wanting to serve mild liquor without the complexity of a full bar license.
• Club License: For clubs registered under the Societies Registration Act, serving alcohol to members.
• Temporary License (P-10/P-13/FL-4): For serving liquor at private parties, functions, or weddings.
• Home Bar License: A new category in some states (e.g., Uttar Pradesh), allowing private individuals to maintain a home bar for personal use.
Common Essential Documents
• Identity & Address Proof: Aadhaar card, PAN card, or passport of the owner/directors.
• Business Registration: Incorporation Certificate, Memorandum of Association (MoA), Articles of Association (AoA), or Partnership Deed.
• Premises Proof: Lease agreement, ownership document, or registered rent agreement.
• No Objection Certificates (NOCs): From the local Fire Department, Police Department, and Municipal Corporation.
• FSSAI License: Food safety license, which is mandatory for all food businesses.
• Health/Trade License: From local health authorities.
• GST Registration: Copy of GST certificate.
• Site Plan: Detailed floor plan of the premises including the bar area.
Key Regulations & Restrictions :
• Distance Restriction: Bars must not be situated near schools, colleges, or religious places (often a 100m to 500m restriction).
• Operating Hours: Regulated by the state; some states allow operation until 2 AM, others till midnight.
• Minimum Age: Selling alcohol to minors (under 21 or 25, depending on the state) is prohibited.
• Dry Days: Bar operations must follow the list of dry days designated by the state.
• Location Area: Some states have eased rules; for example, in UP, the minimum area for a bar is 100 sq mt, and they have removed the need for a completion certificate.
